FOI 00433 - Non elected staff structure

REQUEST 1: Please provide a complete list of the non-elected staff management structure within PFEW HQ. This starts from the CEO position downwards. Only include those who have line management responsibility for someone else and/or whose job title includes the words 'director’, ‘manager’ or ‘supervisor’.

REQUEST 2: Please include the specific job title, date of creation of role and the salary/renumeration of that position (to include any bonuses / performance related pay / compensation).

When providing the information it should be clear who an individual role reports to. Please provide this in a ‘family tree’ style, if possible.

RESPONSE 1: Please find below an organisational chart (please use the link) for the non-elected staff management structure with the Police Federation of England and Wales headquarters at Federation House in Leatherhead.  All roles where not demarcated below refer to positions of manager. There are no positions with the role supervisor in the title.

RESPONSE 2: In accordance with the cases of Information Commissioner v Halpin (GIA) [2019] UKUT 29 (AAC) and Cox v Information Commissioner and Home Office [2018] UKUT 119 (AAC) where the Upper Tribunal considered the following:

‘whether the general public interest in transparency, and in particular the public interest in the disclosure of the names of public officials exercising public functions and powers in the public interest, is necessarily a “legitimate interest” at the first stage of the test for the fair processing of personal data for the purpose of paragraph 6 of Schedule 2 to the Data Protection Act 1998.’  In the appeal of Halpin (cited above), the Upper Tribunal confirmed that in matters such as the request for disclosure of the names of employees, and further information such as qualifications or salaries/compensation/bonuses/performance or even start dates or job creation dates the following legislation is to be considered: ‘FOIA provides for a number of exemptions from the general right to information in section 1(1) FOIA.’ This request is ‘concerned with the exemption in section 40(2). The effect of this subsection, along with section 40(3) and the relevant provisions of the Data Protection Act 1998 (or, since 24th May 2018, the Data Protection Act 2018 but which makes no material difference for present purposes), is that information which is the personal data of a third party is exempt from disclosure if disclosure would not be compatible with the data protection principles in the Data Protection Act (‘DPA’).'

Whilst the request has been for information for senior positions within the organisation internally, these are not public facing roles. We have taken the judgement of Halpin and held that ‘disclosing th[is] level of information would not be within.. …reasonable expectations’ to do so.

Please find below the latest figures from Federation House of the corresponding pay bands in relation to the above organisation chart. Salary bands have been widened in accordance with organisation changes made since the last review July 2023. Therefore, we have applied this exemption in line with the aforementioned appeals and section 40 (2) of the Freedom of Information Act 2000 to all other parts of this request except in relation to salary information that we have provided in accordance with bands below:
