I would like you to provide details of your liability insurance including the total amount that the liability insurance will cover in the event of a claim against the PFEW for negligence.

The Police Federation of England and Wales (PFEW) confirms that it holds Professional Indemnity and Directors and Officers (Management Liability) insurance. 

In respect of the total amount that the liability insurance will cover in the event of a negligence claim against the PFEW, the PFEW relies upon section 43 of the Freedom of Information Act 2000 (“FOIA”). Namely that the disclosure of this information would be prejudicial to the commercial interests of the PFEW.  This position is taken on the basis that: 

  1. Should a professional negligence claim be brought against the PFEW, the release of the requested data into the public domain may prejudice the PFEW’s interests during any such proceedings, particularly in any negotiations regarding the same.  
  2. The PFEW considers there to be little public interest in the level of cover available to the PFEW being disclosed to the public. Against this, the PFEW considers that there is a strong public interest in it being able to litigate (should this be required) in the way that a normal litigant would be able to, without its negotiation position being weakened by its opponent having knowledge of the information requested.
