Federation launches monthly surgeries with personal injury lawyers

Members will now have the opportunity to meet with lawyers with expertise in handling personal injury and clinical negligence claims at a series of monthly surgeries being held at the Federation’s offices.
The clinics are available to all Federation members, and their immediate family members with the first being held at Guardians House next Tuesday (22 September).

- Accidents on duty
- Injuries from animals
- Injuries during training
- Injuries in public places
- Trips, slips and falls at work
- Stress with work/ complex PTSD
- Clinical negligence
- Professional negligence
- Noise induced deafness claims
- CICA appeals.
The surgeries are not for RTC related claims and these should be directed to the Police Federation RTA Legal Assistance Service.
The Police Federation of England and Wales (PFEW) supports personal injury (PI) and clinical negligence (CN) claims for members, and also for their immediate family, including partners, children, siblings, parents and in-laws.
The majority of these claims are handled by the Federation panel solicitors under a conditional fee agreement (CFA, no win, no fee).
The important difference between PFEW funding and alternative funding options that members may find “on the high street” is that, if members are successful in their PI claim, they get to keep 100 per cent of any compensation awarded.
Time limit
The intention of these surgeries is not to discuss claims which have already been allocated to a Federation panel firm and are ongoing, but to help members who have not yet made a claim.
To succeed with a PI claim, negligence must be established against the defendant. The claimant must be able to prove they were owed a duty of care by the defendant and that by their acts or omissions, the defendant breached that duty of care, giving rise to a foreseeable risk of injury. The claimant must also show any breach of duty caused some injury to be suffered.
It is important to note that in the UK, the time limit (limitation period) for issuing court proceedings with respect to a PI claim is three years.
